Use of the Student Wellbeing Hub (SWH) is subject to the Terms of Use set out below. Please read and ensure you understand these Terms of Use prior to using the SWH. If you proceed to use the SWH, your use will be taken as acceptance of these Terms of Use.
Education Services Australia Limited (ESA) may amend these Terms of Use from time to time. You are responsible for regularly reviewing them. Your continued use of the SWH constitutes your agreement to the most up-to-date version of the Terms of Use at any given time.
Please note that no legal relationship is created between the Commonwealth of Australia or ESA and any SWH user.
IN THESE TERMS OF USE:
Content means content appearing on the SWH which is owned by the Commonwealth of Australia or ESA. For clarity, Content does not include content on any Third-Party Website or elsewhere;
ESA means Education Services Australia Limited;
Student Wellbeing Hub or SWH is the Student Wellbeing Hub (including the SWH Professional Learning Courses and the SWH School Wellbeing Check), but does not include websites to which the SWH has links;
Third-Party Content means content appearing on the SWH that is owned by a party other than the Commonwealth of Australia or ESA;
Third-Party Website means a website that is owned and/or operated by a party other than the Commonwealth of Australia or ESA.
OWNERSHIP OF AND LICENCE TO USE CONTENT AND THIRD-PARTY CONTENT
Unless indicated otherwise:
- all intellectual property rights subsisting in the Content and the SWH are owned by the Commonwealth of Australia or ESA; and
- the Content may be used in accordance with the Creative Commons Attribution 4.0 International (CC BY 4.0) licence.
Where particular Content is indicated as being offered under a licence other than the CC BY 4.0 licence, that Content may be used in accordance with the licence indicated.
Acknowledgement is given underneath Third-Party Content indicating that the content is owned by a third party, except for the Third-Party Content used in the SWH design and listed at the end of these Terms of Use.
Where Third-Party Content is not indicated as being licensed under a Creative Commons licence nor as being from one of the specified third parties listed below, that Third-Party Content may be used, reproduced and communicated free of charge for non-commercial educational purposes, provided that any acknowledgements appearing on that Content are retained and moral rights are respected.
Third-Party Content from these specified third parties may be used as follows:
- Pixabay images are in the public domain and may be used freely;
- Flickr images are available under certain Creative Commons licences, and a particular image may be used in accordance with the terms of the corresponding Creative Commons licence specified and linked to in the acknowledgement;
- ESA images may be used for non-commercial educational purposes; and
- 123RF, Alamy Stock Photo, Getty Images, iStock and Shutterstock images may be viewed only.
Where you use the Content and/or Third-Party Content in accordance with these Terms of Use, you do not need to comply with the requirements of any statutory licence (for example, pay royalties to a copyright collecting society such as the Copyright Agency) for that Content or Third-Party Content.

The SWH contains links to Third-Party Websites. The Commonwealth of Australia and ESA:
- are not liable for Third-Party Websites;
- do not control Third-Party Websites;
- make no representations with respect to the intellectual property rights in the content of Third-Party Websites; and
- do not endorse or control the content on Third-Party Websites or any associated organisation, product or service.
Your access to Third-Party Websites and use of their content is at your own risk. It is your responsibility to read and comply with any terms of use and legal notices that apply to Third-Party Websites. You should exercise your own independent skill and judgement before you rely on the content on a Third-Party Website. The SWH is not a substitute for independent professional advice and you should obtain appropriate professional advice relevant to your particular circumstances.
SWH contains links to Third-Party Websites which, at the time of linking, were perceived as being relevant and of educational value.
